Child choosing his primary residence
My son is 12 years old and has legally signed paperwork that has him choosing to live with me. He is worried that his mom will see this paperwork prior to the final judgement and will be notified while he still has to live with her. Is this form included in the paperwork she will receive when she is served or is this something that will not be addressed until the hearing?

It is normally filed at the same time as the petition. Normally she would see it at the time of service. It would normally be in the public records of the court. If she is not made aware of the child's choice, then the court is not made aware of the child's choice. Do you have a lawyer? If so, you should address these concerns to him/her. If not, you really should, if custody is at issue.
