Legal Question in Family Law in Texas

child cusody and child support

I have been paying child support to my ex-wife every month since my divorce in 2001. I have been working out of state. My ex has custody, but y child has been living with my mother for over 7 months as my ex wife lives with her sister and sisters family - in the finished out one room garage w/ her new boyfiend. She has not had a steady job in over 3 years and has been living off of the child support money I send. All of my childs clothing, food, etc. have been paid by my moher and myself - in addition to the chils support I have been sending ($500/month plus an additional $400/month as agreed in the original divorce decree) I have moved back to to town to be near my child and try to correct the situation. I would like to get custody of my child, as I have a steady job and home for her in town - I have even moved into the same school district as she has been going since moving into my mothers house. I now have joint custody w/ limited visitation. How would I try to get legal custody of my daughter ( 9 yrs old) and are my chances good? I do not want to prevent visitation w/ her mother - simply to be in the best stable environment on a permanent basis.

Re: child cusody and child support

You will have to prove that your custody is in the best interest of the child. You have a good chance if your case is put together right. See and lawyer and discuss the detail that you outline here. Good Luck.
