My divorce was granted in texas my ex now lives in new mexico. my oldest daughter is 12 and wants to come live with me. will the custody hearing be by texas law or new mexico

Texas, EXCEPT that your ex may have the option under New Mexico law to transfer the case to the county of residence. It will depend upon who gets to the courthouse first, and what are the parameters of New Mexico law.
