Legal Question in Family Law in Texas

Best for child????

The custodial parent has a new job where she rotates graveyard shifts (530pm-330am) every 2 weeks. She is asking the non-custodial parent to take the 5 year old child to school at 745am and she will pick him up from school on those days at 300pm but, will take him to the non-parent at 430pm the same day before her graveyard shift. The custodial parent says she is going to ask for this arrangement for as long as she works the new job. She plans on being there for as long as she can. Should the non-parent ask to be the custodial parent because of this? I think the child it is going to be burned out due to this arrangement. Please any advice will do. Thank you

Re: Best for child????

Children are resilient and can withstand a lot. My suggestion is to give this a try and see if it is working out for the child. If it is a problem, suggest that you try to work something out with the custodial parent that you agree would be better for the child. I also suggest you consult a psychologist who specializes in this area. If the matter goes to court, the court will want to hear a professional's point of view.

Another issue that needs to be resolved is what is the custodial parent going to do when school is not in session? She has to sleep sometime.

If this solution involves you spending more time witht he child, i.e. you care for the child on the 2 weeks when school is not in session and mom is at work, you need to think about adjusting the child support obligation.
