Legal Question in Family Law in Texas

Child Custody

I had a baby with my boyfriend when I was 18. I recently got married and am having another baby. My husband wants to adopt my first child but the father will not agree. Now, after 2 years of never being there, he wants custody because I got married. What can I do to prevent him who is a stranger to my child from disturbing my family?

Re: Child Custody

Sounds like a contested adoption. Can you prove that he has not been there? Can you prove that he has not paid child support? Those are two things that would prevent him from being successful in opposing the adoption. Serve him the papers. Bring him to court to let him tell the judge that now he wants to be a daddy when he hasn't been there for 2 years or more. Quite often when they get the papers, the lose their nerve. This will cost you a little bit of money and you will need a lawyer to do this, but if you want your child to have a real daddy, this is the process. See a lawyer.
