child custody battle
My exboyfriend, the daddy of my 25 day old baby smokes, drinks, & has a bad temper. He also has a history of abuse in his family. He is threatening to take me to court to get custody of the baby. He wasn't around during the entire pregnancy, and he even requested to not have his name on the birth certificate, therefore my son has my last name. Can he even take me to court? I am on Medicade and he isnt listed as the father. Can he legally do anything?

Yes, he is the biological father of the child and he has the right to establish paternity and sue for custody or at least visitation rights. Perhaps you should have considered his smoking, drinking, bad temper, and family history before you had a child with him. For better or worse, as the daddy he has rights.
You REALLY need to find a good family law attorney and see about doing something yourself before he does. Repeatedly asking the same question here isn't going to help or change the answer.
