My brother and his girlfriend have a 15 month old son, the mother of the child is not of stable mind. She has left several times, and when she leaves she leaves the baby with my brother. Now cps is involved, because she said my brother tries to kill her. what kind of case does she have on him if what she is saying is not true?

Your brother needs to take steps to gain custody of the child. He will have to prove that the mother is of "unstable mind" through competent testimony, e.g. a doctor, psychiatrist or psychologist. Maybe she has MHMR records that could be sponsored by the treating physician. This only gets worse if proper steps are not taken to resolve this situation. I suppose the mother could get treatment for her mental illness. Maybe then she would be OK. Good Luck.
