Legal Question in Family Law in Texas

child custody

my brother in law has two children with his girl friend one is age 2 n the other age 1 well they have decided to seperate becuase she goes out too much (clubs) he wants to knw wat he can do to get custody of the children . At the moment they are living together but he is planing to move out . the problem is that his girl friend's mother has the oldest child custody what can he do ? the other thing is that he is an ilegal alien does that affect him in any way?
