Legal Question in Family Law in Texas

child custody

My brother and wife have been separated for over a year. They have a 3 year old daughter together. His wife is now living with another man. My brother found out that her boyfriend spanks his daughter. Is there anything my brother can do legally to stop this? Can he keep his daughter and not give her back to the mother?

There are a number of things he can do legally. Is there an order concerning the child? If not he could seek custody. But I can't imagine any responsible person (lawyer or layman) suggesting that he take the law into his own hands by taking the child and not giving her back. I cannot think of anything more risky. Better get a lawyer.
