Legal Question in Family Law in Texas

Child Custody change

Hello,

I have a quick question. My kids and I have been living here in San Antonio, Texas for almost 2 years now. The father of my kids lives in California. I am having a lot of problems with my 16 year old son and I was wondering if I have the legal right to have his father take custody of him. I have sole physical custody of both kids. But I am not able to handle my son anymore and his father doesn't want the responsiblity. Do I have the right to change the court order to have him be the custodial parent of my son?

Any help you give me would be greatly appreciated.

Thank you,

Dawn

Re: Child Custody change

You cannot do it unilaterally. You can petition the court to modify the conservatorship, and notice the father of the hearing. It is difficult to envision that the court will force a 16 year old to go somewhere he doesn't want to go, and where he is not wanted. You will need to retain an attorney to handle a situation like this.
