Legal Question in Family Law in Texas

Child Custody, I have two children living with their father. The children are 12 and 9, both would like to live with me. I cannot afford an attorney at this time. How would I go about getting custody of them. It would be in Smith County Texas.

You have to file a motion to modify the previous order. You then have to show a judge (or jury) why it woudl be in the best interest of the children to live with you rather than their father.

You will pretty much have to have a lawyer to do this.
