Child Custody

I have gotten a court order that my ex was filing for joint custody and he wants all the sole rights. The child has never lived with him, but the child was staying with his mother while I was deployed to Bahrain for a little over a year. I came back and took my child 3 months ago. Is the fact that I am in the military going to interfere with me getting full-custody of my child? He is not even paying child support. Is the judge going to look at the fact that his parent took care of her into consideration. What is the possibility that I will not get full custody? He files for custody in the state that the child was at 3 months ago not the current state. Is there something that I can do to counter sue him for all that expenses that he is costing us.
