Legal Question in Family Law in Texas

Child custody

CPS took my daughter from the

mother and gave me the father

temporary custody, the the

grandmother sued me for custody

yesterday scheduling me for court in

3 days. I do not have enough time to

get a lawyer, so what do i need t do

to represent myself, and what are

my chances of getting her back?

Go to court and ask the court for more time to hire an attorney.

Take all the papers regarding this child with you.

Be sure to have extra copies to give to the court.

If she filed, then you need to file a document called an ANSWER. It lets the court know that you are interested in fighting this lawsuit.

I don't think that grandmother has legal standing to sue you. There are limited grandparent rights in Texas and if the daughter is alive and not in prison then generally - usually - grandparents are out of luck.

I would recommend that you ask for a continuance and get an attorney. In Texas, grandparents have limited rights, but she would have to have standing to sue for custody. Good luck to you, and may God bless you and your daughter.
