If the custodial parent wants to leave the country for the minimum time frame of a year, and does not want to sign over custodial rights to the other parent: What can be done to obtain custody if the parent leaving the country decides to go anyway and leaves the child under the care of an aquaintance. (the custody agreement is joint, but she has primary custodial rights)

Can she legally leave without giving the father the option of custodial rights?

It depends upon the wording of your decree. If it silent about the extended absence of the primary parent, then you may want to consider a Petition for Clarification. In any case, you should retain an attorney for a consultation to review your decree, so that your conservatorship is protected during your absence.
