Legal Question in Family Law in Texas

Child Custody

My daughter's mother is denying my vistation rights. I haven't seen her since last summer, and I have been paying support, but I am behind from not working while I was in school. I have been paying since. Now she is trying to modify the vistation, because I returned her one week late, after attend my family reunion, in which I informed her I was going to do. My question is what would be the next step I should take. I wanted to avoid a custody battle, but she keeping me from my daughter, and saying that I have another family to take care of, she won't let her call me, or anything. My daughter said that she didn't want to come with me. She is trying her best to please her mom, to avoid any mental abuse from her. Her mom feels like since I left her and since she doesnt like me, then my daughter shouldn't either. Where should I start my fight with this issue.

Re: Child Custody

You should begin by maintaining a calendar of the dates you were denied possession. You should hire an attorney to file a Motion to Enforce visitation. Visitation and child support are mutually exclusive issues - a parent cannot withhold a child from visiting the other parent based on failure to pay child support.
