Legal Question in Family Law in Texas

child custody

during my divorce, my ex recieved temporary orders for child custody. I have no idea why he was granted temp custody. i am stable, have my own home, have a vehicle, a job, and am going to school. Our divorce was because of my involvment with another man. what are the chances he will get permanent custody when we go back to court? other than this other man, who has a clean background, there are no other complaints against me. also, my ex will not let me have any additional time with my daughter, even after he said he would let me have her for some extra time. can i lose custody just because of my involvement with this other man? or do i need to be proven as an unfit parent first? also, the ex works 12 to 16 hour days and does not spend time with the child, she is at his mother's. so while im out of school or off of work she could be here with me instead of at his mother's.

Re: child custody

It is impossible to say, since the decision was based upon a hearing with testimony and evidence that I did not hear or see. For whatever reason, the court chose him over you. The temporary orders hearing is not very different than the final trial, except that (at least in this county) the final trial involves more depth and evidence and witnesses.

It is not unusual for the final orders to be very similar to the temporary orders -- unless you can present evidence that differs significantly from the earlier hearing.

You should seriously consider what you can do to improve the outcome of the next hearing.
