Legal Question in Family Law in Texas

child custody changes

I was divorced in Oklahoma but now I am a resident of Texas. Child (age 12) lives with me in Texas. If I want to change the custody from joint to full -- or just change the visitation schedule, would I have to file paperwork in oklahoma or Texas?

Re: child custody changes

This can be a complicated question. If the custodial parent and the child have resided in Texas for more than 6 months, then jurisdiction for any motion to modify custody would take place in Texas. Jurisdiction for modification of child support and visitation issues may be retained in Oklahoma if your ex continues to reside there, based on their version of the UCCJEA and related statutes. I would be glad to dicuss these matters further if you would contact me.
