Child custody

My ex-wife moved to Miami in july of 2000. She has my 6 year old son with her. I have visitation rights on the first, third and last weekend of the month and also 30 days of the summer.The problem is that I live in Texas and he stays in Miami. It is to my understanding that she is liable for half of the cost for visitation. My question is, How often am I able to fly him into Texas and have her pay for half the plane ticket?

It purely depends upon what the divorce decree says. Texas has a "standard" possession order, but it is not mandatory. The standard order typically provides for one set of rules when the parents live within 100 miles of each other and another set for when they live further apart. Frequently however, the decree will provide for just the one that is applicable at the time of the divorce.

You should probably take your final decree of divorce (or later document) to an attorney for advise. You should do so as soon as possible in order to preserve your rights before the mother attempts have the action transferred to Florida. (She may or may not be successful in this, but it will be a problem for you.)
