Child Custody

My ex-wife and I have both have

custody of our 2 sons. (Its a 60-40

split, in my favor.) In the divorce

decree, it states that if my ex-wife or

I cannot be in possession of our

children for more than 3 hours while

they are in our custody, then we

must contact the other parent and

give them the right of first refusal.

She is leaving town during her

custody period and she wants to let

her new husband keep my sons for a

day and a half and then return them

to me. What custody rights does a

step dad have, especially when the

decree lays it out that the biological

father has custody and is designated

to have the right of first refusal?

Talk to you previous attorney, with a setup like this you're bound to have had one. Trying to give any kind of answer without knowing all the details would be like dancing in a mine field.
