Legal Question in Family Law in Texas

child custody

My fiance just passed away and I want full rights to my son of 17 mths who has always lived with me. I do work out of town half the time but have a wonderful sister whom i'm ABOUT to move there. But my boys grandmother is threatening to get custody of him while i'm out of town. I dont think she has a chance but what paperwork and documents do i need to gather up so I can give my sister power of attorney and joint custody
