Child Custody

I Have Full Custody of my Daughter Her Birth Father has Visitation, but has not seen her in over a year and is $3,000 behind in child support ,He is a heavy drug user and an alcoholic.

I am Due to have major surgery in June if somthing happends to me I Want to leave My Custody to her Step Dad , Can that be done ??

You can't leave your custody to the step-dad. It doesn't work that way.

You can indicate in your Will and in a Declaration of Guardian for My Child that you would like your child to stay with your spouse if you are gone.

You can give your spouse powers of attorney so he can make decisions for you about your daughter and take care of her medical needs while your are incapacitated after the surgery.
