Legal Question in Family Law in Texas

My husband & I separated 7 months ago and I took custody of our daughter. She is listed on my lease and I enrolled her in school for 2006-2007. We have never filed anything with the court - not even legal seperation. I am going on vacation and have asked my mother to care for my daughter. My question is: can my husband go to my mother's house and demand possession of our daughter? If so, how can I avoid that situation?

Yes he can. Only a court order delineating everyone's rights and duties will prevent him taking your child. He is the father, and has equal rights to his daughter.
