What do i do if my husband has a son in state custody and he is out of the country until further notice ehat rights do i have to file for custody on his behalf

It is impossible to properly respond without much more information. Will your husband return soon? Is his absence immigration-related; or personal or business? How old is the child? Assuming this is your stepchild, what is the status of the child's mother? You probably need to consult directly with an attorney to explore the options available.
