Legal Question in Family Law in Texas

child custody and infidelity

My husband is seeking a divorce and legal custody of our 16mo old child. I have been a stay at home mom since she was born and have recently returned to day school (baby is watched by her 18 year old half sister while I attend school). He plans to use a one time incident of marital infidelity on my part (occured 3 years ago and he has known for 2 years) as basis for suing for custody. In that 2 years I thought that we had worked out our differences and feel that there are new issues that he is not sharing with me. How will this be viewed by a judge in Texas?
