Legal Question in Family Law in Texas
child custody issues
I have a 3 yr old son. His mom moved to tx last 03/07 and I moved here in 2/08 to live with my mom to be by him etc. I pay child support, watch him more than 50% of time, and love him to death. She is now threatening to move back to CA. I am awaiting court date to secure visitation rights etc, but CS here in Tx says she can move back and I have no rights .. Is this true. The mom has lived with my son in my mothers home since before he was born it's only now since she has been asked to move out etc, ie grow up, that there are problems. I love my son, what can I do. I am told that no court date, the judge will decide visitation? Each person says different, except that hey, too bad, so sad, get a lawyer. I'm 21yrs old. Can you give me any advice

Re: child custody issues
I am surprised by your last comments. You are old enough to father a child, support that child, emotionally bond with that child and physically care for that child; yet claim you are too young to understand the necessity of getting a lawyer to protect your rights to that child.
Without a lawyer you are at a significant disadvantage. SIGNIFICANT. I don't know who CS is or why CS said you have no rights -- but you need to be taking advice from an experienced family lawyer -- and you need to do that immediately. Plenty of excellent lawyers will work with you on a payment plan. If this child is important to you, you will get this done.
