Child Custody

I have joint custody, my son lives primarily with his mom. She is having behavior issues with him at home and at school. Her husband is a 3 time felon, has bruised my son, CPS has invest. 3 times and removed him for one night. She has him around her family that is on drugs and he has been in the middle family fighting and violence. There are no problems at my home. Her only complaint is I have been 15 minutes late bringing him home and she says that I call him too much. Would I have a chance in court to gain primary custody?

You would have a chance if you take this seriously. You will have to prove each and every allegation that your stating here and also prove that it would be in the child's best interest to change custody. Bruising and drugs (if you can prove the drugs) would be a good reason to change custody. This is very hard work and can be somewhat expensive. I find many people who want to change custody, but when I tell them my retainer is $10,000 some people decide that the issue is not all that important. You will likely have to hire an expert - perhaps a child psychologist or perhaps a learning skills expert to substantiate your claims. Good Luck.
