Legal Question in Family Law in Texas

child custody

I have a letter from my son ex giving us temporary gardianship of our grandson since sept. of 2004 and he still resides with us and we have not recieved any money from her for child support. Is there a law that sipulates how long temporary guardiansip is and if thats the case what about child support?

Re: child custody

There are two paths to resolving your question. One is a guardianship under the probate code. The second is a suit affecting the parent child relationship under the family code. You will not be able to get child support with a guardianship. However if you file a Suit Affecting the Parent Child Relationsip under the Family Code, you can ask for court ordered child support. This will be based on your son's income.
