child custody

Live in Texas . Divorced. I have the custody of my only son. father is in Texas as well. is it considered kidnapping if I take my son back to Mexico without my exhusband approval?

The Texas Penal Code 25.03 lists the offense of Interference with Child Custody, which states that " (a) A person commits an offense if the person takes or retains a child younger than 18 years when the person

(1) knows that the person's taking or retention violates the express terms of a judgment or order of a court disposing of the child's custody; or..."

It is a state jail felony.
