Child Custody and Living Location

I am in the Air Force stationed in Germany and I am about to go trough

a divorce. My wife is a resident of TX and am a resident of NJ. We were

married in NJ. I am trying to see if I can use her residency to file in

TX.

Also, after the divorce she wants to remain here in Europe and I am going back to the states. I do not want the kids to stay here and live on the local economy, and she is not willing to give me custody. What say do I have about the kids living outside of the US?

You can use her residency in TX to file for divorce. You would have to convince a TX court that your custody would be in the best interest of the child(ren) and for them to return to the US. Availability of TX and US services could be a good reason. You will have to prove this to the Court. Maybe the JAG office can provide you some information on this subject. You will very likely need the services of a TX attorney to accomplish your goals. Good Luck.
