Legal Question in Family Law in Texas
Child custody military
I am currently in the military and was moved to Germany last Feb. 06. We obtained a passport for my step-son through the US State Department because my wife has the exclusive right to establish his residence without regard to geographical location. We have been notified my the bilogical fathers attorney that he is seeking custody now. My step son is eight nine and has always lived with his mother (parents never married). His father has moved multiple times since he was three years old. His biological father was only ordered to pay 157.00/month in child support and never updated the courts on his income even after he graduated from law school. Additionally he has never obtained the court ordered medical insurance for his son. He only followed the standard visitation order when it was convient to him and his spouse. He was recently order to increase his support to 500.oo per month by a court mediator. My lawyer is telling me that he is going for custody to stop the child support payments. Would someone stoop this low? We ahve agrred to let our son live with his father for one semester but his bio-father still wants full custody. Does he have a case?

Re: Child custody military
You say he graduated from law school? Quite obviously he would stoop so low. You and your wife are going to have to contest this custody battle. You have some good evidence. The bad part is - it's going to cost some money, or you will lose. If this is important to you, start right now to find a lawyer who will work with you on this case.
