Legal Question in Family Law in Texas

child custody

I am a minor who has been taking care of a four year old child for the past two year. I have a relationship with the father who is financly there but not phicaly. The mother didnt want to be there for the child when she was two. Now they are fighting for custody but the father doesnt want me in the problem. what should i do? does this mean i have dedicated two years of my life for nothing? i told him that after he gets custody we either get married and he has to sign a prenup giving me custody if he goes to jail,dies, or we get divorsed. is this possible?

Generally parents defeat unrelated parties in custody disputes, but there can be exceptions. You may wish to look through the family code linked on the links page (Texas Statutes) of my web site. In other words, one parent can not "will" a child to a third party over the rights of the other parent.
