Child custody modification questions
My ex filed a motion to modify custody and temp. orders granted his custody. I did agree to temp orders due to 11y old son wanted to get to know dad better. This was 6 months ago and no hearing has been set for permanent orders. My ex has told me he cannot afford the 1500.00 his attorney wants to finish case. My ex has also changed is mind and not only does he not want custody but wants to terminate parental rights. He has made it clear to my son he does not want him yet he will not let him return home until it is court ordered. He is willing to sign an agreed order to return him home but wants parental rights terminated so he does not have to pay support. I am agreeable to this. I have no money for an attorney but will do everything myself if I knew what needed to be done. My questions are : Is their a time limit they have to set a hearing to finalize his motion to modify(it has already been 6m)? I have heard it is hard to terminate parental rights so what can I possibly due to return my son home? He will not agree to an order if he has to pay support. My son calls me everyday to ask if I got a court date and I don't have the answer so any advice would be so appreciated.

First of all, your situation really needs the expertise of an attorney. Contact North Texas Legal Aid, and if you qualify as indigent, you will not have to pay filing fees either. Your ex-husband's position is unreasonable. Do you have visitation rights? Is your son in the same area as you? These are not the circumstances where a judge will allow him to escape his responsibility for child support. TCL
