child custody

have a 4 month old girl. father just filed for custody. how can i file for custody before i am served with his papers.

If a suit affecting the parent child relationship (SAPCR) has already been filed, you may file a counterpetition. Whether you have been served with the papers yet or not has no legal relevance to the effectiveness of a counterpetition.
