Child Custody & moving out of State

My ex & I have a divorce decree. We share custody of our three children, they are with me one week & with him the next. There is no child support. He can no longer care for them & he wants me to take primary custody of them. Our decree states that if he moves out of county, I retain primary custody & can move. Can I just move out of State? I don't want to make the wrong move & risk losing my children.

All of the steps you contemplate should be covered in an Order modifying the divorce decree. You will also need to consider the issue of child support since you will be the primary conservator. You do not say if he is moving out of county, but if your geographical restriction allows you to move if he does, then you will need to wait until he moves.
