Legal Question in Family Law in Texas
Child Custody
What does it take to prove that a parent is unfit and that a child should change has primary residence? If a parent is NOT found unfit, would a judge split the children to different homes should one of the parents only want one of the children? If a child is underage to make the choice of changing the primary residence, can he still request a change and be granted that change should both parents be found fit?

Re: Child Custody
If there is abuse, the court will change the residence of the child. The easiest way to prove this is through child protective services. They are prone to protect children if there is enough proof of abuse. You would be well advised to have a child psychologist available to review their investigation because while they do a good job, they have a tendency to posture the case to send the children back to the parent.
