Child Custody

I have been raising my grandson since birth. He is now 18-mos-old and my husband and I are his sole providers and caretakers. My daughter wants to give us custody. I understand the SACPR forms and how to file them so no problem. Problem: Father is in prison since child was 2-mos-old and is not due to get out until child is 8, possibly paroled when the child is 4. We want him to be a part of the child's life and have reasonable visitation, but for now, can he stop us from getting custody? I understand he has to be served copies of any orders since he is the father and has parental rights. Note: Father is a convicted sex offender, if that has any bearing. Please do not suggest an attorney. No one in my city will touch a custody case for under $3,000 to start. TX Rural Legal Aide is also out. They don't have time to work a court case - I've already asked them. They did, however, send me a ''Power of Attorney Establishing Grandparents Rights'', which my daughter did sign.

There is not much he can do from prison. Just make sure you serve him with the SAPCR. However when he gets out, understand that he might file an action of his own.

Suggest you keep trying for an attorney at a reduced rate. If mom is in agreement this does not look very hard.
