Legal Question in Family Law in Texas

child custody

I reside in Texas, my husband resides in Maryland. THere is no legal order stating he has custody of our 2 kids. I have had them soley in my care for 5 years. They went to visit for the summer and he says he will not send them back. We are not officially divorce, however I did receive a petition for separation. Does he have legal grounds to keep them away from me?
