Legal Question in Family Law in Texas

child custody

What rights! I pay child support and i have been current until now. I owe 500 dollars in back support,i don't have the same job anymore and work has been really slow for me lately. Recently i received a call saying that i need to pay 300 dollars by 12/19/2008 or my license will be suspended and i just paid 150 dollars on 12/6/2008. I am currently engaged and supporting another household, i also have a 7 month old daughter. My ex-wife doesn't abide by the legal arrangements that we have i don't see my daughter on all my weekends, and when she does come over i can't get her until saturday and i'm supposed to get her on fridays. I also don't get to see her on christmas or father's day because she won't answer the phone and she won't let me take her out of town to see my mother all of these things are in the arrangements please tell me what to do so i can have my rights exercised also.

Re: child custody

Hire a good family law attorney. You may be able to do an enforcement against your ex for not allowing visitation as ordered, and you may be able to do a modification to reduce your child support and work out a payment plan for the arrearage.

Re: child custody

Filing for enforcement of your custody agreement will probably require the assistance of an attorney. You can try going to the law library and researching how to do it yourself, but there is a mighty steep learning curve on these things.

As for the child support, however, call the Attorney General and ask them if they will do a modification on your support. The magic words you will have to say to them are that you have a "change in circumstances" and that you would like them to recalculate and do a modification.

The AG tends to be backlogged, so it probably won't be nearly as quick as if you had your own attorney do it, but it's better than doing nothing and getting behind. Also make sure to follow up the phone call with a letter so you have documentation.
