Child Custody

I am seeking sole managing conservatorship of my son. His mother is in the military and has been deployed for 15 months. I believe that her absence, history of family violence, alcohol use and domestic violence in our past relationship that I have personally been a victim of, demonstrate how it would be in the best interest of my son to continue living with me upon her return. I live in Texas and she will be living in Kentucky when she returns. We have never been married.

There is no question here. I assume you want to known how to proceed.

There is no indication of the child's age or the current custody situation. Do you understand that sole custody has to do with your rights and duties as a parent not whether or not or how much she sees the child? A word of caution, since she's in the military, citing her absence from the child is not going to win you any points. Her history of violence and substance abuse might, if it is documented.

You need to sit down with a good family law attorney who has handled cases involving active duty service members and discuss your options.
