Legal Question in Family Law in Texas

Child Custody

I had sole custody of my child until he was 13 when he wanted to try living with his father. Now we have joint custody. My son is 16 and wants live back with me again. His father is not allowing this. My son will be turning 17 in June. What recourse do I have and is a lawyer necessary for my son to move back in with me?

Re: Child Custody

Courts in Texas will consider a child's wishes when determining where the child will live.

In order to have the custody situation changed, you would need to file a petition to modify the current court order governing custody.

While a lawyer is never "necessary" in a custody matter, hiring an attorney is often a very wise decision.
