Child Custody

My son is 15 and has been living with his father for years. Recently he has been dealing with issues with getting in trouble at school and with his father. He father recently gave up and called me on day and said he didn't want our son anymore and that he would be moving in with me. So my son has been back with me since April. He recently went to go visit his father and now his father has changed his mind and won't let him come back home now. What is there that I can do? Legally it still shows his father has custody.

File a Petition to Modify, and present this evidence to the court, and the court will resolve the issue in your son's best interest. At 15 he will he be able to advise the court of his preferences.
