Legal Question in Family Law in Texas

Child custody - summer visitation rights

I live more than 100 mi from my ex, but in the same state. My son lives with him. I am allowed 42 days for summer visitation and with written notice by April 15th (which I got on May 1st), my ex is allowed to come and get him while he is visiting me for two weekends during my visitation. Does that mean that I get less than the 42 days allowed and if he sent me the request later than April 15th, can I deny him the weekend visitations? I don't want to deny him, but he does not want to give me my 42 total days, which is what I want. Thankyou for you help in this matter. - Frustrated

Technically the notice was late, so technically you can deny him. Plan on him complaining to the court, and plan on the judge being very irritated with you. The judge may even further restrict your visitation. Sharing conservatorship requires getting along. Why would you want to deny your child the opportunity to see his dad for a couple of weekends during the summer? I don't know how old your son is -- but there will be many times similar to this down the road, and both parties need to compromise, or your son's life is going to be miserable.
