Legal Question in Family Law in Texas
child custody
My ex is taking me to court for enforcement of possession. He says that I refused to let him see our daughter the past three years, but he never contacted me or even came by to pick her up. So what should I do? Also he filed court papers in a different county that I do not live in. Also when you are served with papers is it supposed to be police officer that serves you and are you supposed to sign anything stating that you received the papers? Is it legal for just a regular citizen to serve you and also should they have to put their name on the papers stating they are the person who served you?

Re: child custody
sounds like you really, really, really need a lawyer. He could possibly bring his motion to enforce in a county that you do not live in -- if that is the county with jurisdiction over the child -- possibly where the divorce was granted or orders concerning the child were first issued. If your X had a lawyer file the papers, I can't believe that his lawyer would not know that. I suggest you get a lawyer. Good Luck.
