Legal Question in Family Law in Texas

Child custody / visitation

My ex-wife is trying to serve me papers for a motion filed in Minnesota. I live in Texas. If I never get served, and do not respond, can she take custody from me ?

She willingly signed over custody to me 8 years ago, our daughter is only 9 years old. She has just ''decided'' she wants custody now because I moved to Texas.

You could be served by publication in MN. But you could file your own motion to transfer & she would have to come to TX. Find an attorney. Good Luck

Just accept the service and hire an attorney.

I agree with Mr. Grissom and Ms. Brochstein. I also am concerned for your position, if you violated a geographical restriction. The specific circumstances of your case have a serious effect on the outcome. They are correct. Retain an attorney. Attempt to transfer the matter to TX (It might not be successful, depending up the specifics). Avoiding process, will only give her the power to eventually take an enforceable judgement against you.
