Child custody wanted--but was never married

After being together 4 years, & being engaged for 3, I found out my fiance has been seeing someone else. We worked things out, but 2 weeks later she said she's going to move out anyway.

She's since moved out, and currently in another state with the other guy, & may be back in two months. She's become increasingly untruthful lately, and I'm concerned if she comes back and wants to take our 3 year old son for a weekend, I'll never see him again.

What I want is some kind of legal document stating that I'm the primary guardian, giving me protection against such things, but still giving her visitations. Since we were never married, I'm not clear on how to handle this.

You are as much a parent to the child as the mother - maybe more so. If you want to keep the child as you say, you better get with a good lawyer to start a Suit Affecting the Parent Child Relationship (SAPCR). This is not the time to worry about saving money if you want to keep the child.
