Child Custody / Welfare of the Child
I have serious concerns about how my ex-wife is caring for our daughter. My little girl is 11, and in the 5th grade. On a consistent basis, she appears unkept (dirty, clothes that are too small/age inappropriate, etc). She is constantly sick (colds, flu, etc), and I have just found out she is failing 3 subjects in school. She lacks basic social skills, and is exceptionally immature for her age. I don;t know if I have a legal right to demand certain treatment of my daughter, or if I shuld simply sue for custody. I want what is best for my little girl; I want her cared for, and educated properly, but my visitation schedule only gives me a limited amount of time to try and correct the situations. Any advie would be greatly appreciated.

I seriously doubt that your efforts during visitation will make discernible difference on any of these categories. If you want to change the situation, it will take a long-term, full-time commitment - beginning with seeking custody - which will take a serious financial committment - and may not be successful. One thing for sure, you will need at least one expert (maybe another) to evaluate the child and be ready to testify that you can correct all these deficiencies. That ain't cheap. If these issues are really important to you, get a lawyer and get started. Otherwise, -------- well, otherwise.
