child custody

My wife is under endictment for manufacturing and transporting methamphetamines. We have been separated for over two years and are soon to be starting our divorce proceedings. Does this prove her unfit and can she fight me for full custody from jail? What steps can i take if she goes to jail and also if she doesnt? Thank you in advance

If your wife in under indictment but not convicted it will still be a major factor for the court to consider. She doesn't have to be convicted for the court to consider the evidence in deciding custody. I suggest that you file and seek temporary custody but talk to an attorney first. Every case turns on its own facts.
