Child custody

If a woman has a child while she is married by another man other than her husband who gets custody and who has to pay child support?

There is a legal presumption that the child born during a marriage is a child of the marriage. The legal presumption can be overcome with a bio father being named, and coming (or being forced) forward to take responsibility. Best resolved with legal representation.

A child born during a marriage is presumed to be the child of the husband. However, a suit to adjudicate parentage can be undertaken to overcome that presumption and to establish who has what child support obligations.
