Legal Question in Family Law in Texas
re: child custody
Hi I was wondering how much it would cost to change a divorce decree stating joint custody of a child to sole custody? My husband currently has joint custody of his 5 year old son and we would love to have full custody of him. He has been enrolled in school with us for the past two years and I have had on under my insurance and Medicaid for over three years. We have his son every Thursday and his mother gets him Thursday since she is off on Fridays. At home he shares a room with his 6 year old step brother and with his mom sleeps in bed with her since she has her dad and sister living with her in a two bedroom apartment. We both have way more time for him and when we work after school he stays with his grandparents. My husband is off 3 days a week and his mother only on the weekends. During the week shes out by 8:00PM. What can we do? Imp tired of her not wanting to help us pay for his medical expenses and other necessities that he may need. She receives a child support check yet we never see her use it on him for anything. What can we do and is it expensive

You need to file a modification seeking a change of custody How much it costs will depend upon how hard the mother is able and willing to fight your requested change. You can file a modification of custody and see if you can convince the Court the child would be better off living with you than his mother. The best way to do this is to hire a good family law attorney. As to how expensive it will be, that depends on how hard the mother fights the modification.
