Child Custody

I am writing on behalf of a friend who is recouperating from surgery complications. I am disabled and on Medicare/Medi-Cal and she has no income coming in right now. She is also scheduled to go back in for surgery on October 5, 2008. Her ex-husband had custody of the mom's son during her rehabilitation. The dad passed away unexpectedly and she is not capable of caring for her son at the moment. The step-mom has agreed to take care of him. The son is 16 years old and would like to remain in Big Springs, Texas where they currently live. Her son�s wishes are to remain in Texas and graduate from the current high school he is attending. My friend needs to know what she needs to do to retain custody so Child Protective Services doesn't come in and take him out of the home he is presently residing in and how to get the Child Support checks which come from the State of Oregon into another person's name since they are in her ex-husband�s name? Is there some sort of letter she can write to let her son stay with the step-mother without gaining custody and at the same time give permission for the step-mother to sign for him legally if anything should happen to the son medically?

There is too much missing/mis-information here to really make any suggestions. Perhaps the best bet would be for the step-mother to contact an attorney.
